Terms of Service

Agreement to Terms

By accessing or using the Dragon IoT mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App.

These Terms constitute a legally binding agreement between you and DragonTV Limited ("we," "our," or "us"), a company registered in the United Kingdom (Company No. 06236913).

Description of Service

Dragon IoT is a home automation platform that allows you to:

  • Manage multiple properties and connected devices
  • Create location-based and time-based automation rules
  • Monitor and control IoT devices in real-time
  • Receive alerts and notifications about your properties
  • Integrate with third-party smart home services using your own API keys

Account Registration

To use the App, you must:

  • Be at least 13 years of age
  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information to keep it accurate
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account

You are responsible for all activities that occur under your account.

Acceptable Use

You May:

  • Use the App for personal, non-commercial purposes
  • Connect and control your own IoT devices
  • Share access to your homes with other authorized users
  • Export your data at any time

You May Not:

  • Use the App for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Reverse engineer, decompile, or disassemble the App
  • Use the App to transmit viruses, malware, or other harmful code
  • Interfere with or disrupt the App or servers
  • Harvest or collect user information without consent
  • Use the App to spam or send unsolicited communications
  • Impersonate any person or entity
  • Resell or redistribute the App without authorization

Third-Party Integrations

The App allows you to integrate with third-party smart home services (such as Sensibo, Xiaomi, BYD) using your own API keys and credentials.

Your Responsibilities:

  • You are responsible for obtaining and maintaining valid API keys from third-party services
  • You must comply with the terms of service of all third-party services you integrate
  • You are responsible for the security of your API keys and credentials
  • We are not responsible for changes, outages, or discontinuation of third-party services

Our Role:

  • We act solely as a conduit, using your credentials to interact with third-party services on your behalf
  • We do not guarantee compatibility with any third-party service
  • We are not liable for any issues arising from third-party service integrations

Location Services

The App uses location services to provide automation features. By using location-based features, you acknowledge that:

  • Your device's GPS coordinates are processed locally on your device
  • Only coarse location data (zone status) is synced to our servers
  • Automation rules may trigger based on your location
  • You can disable location services at any time through your device settings (though this may limit functionality)

Intellectual Property

The App and its original content, features, and functionality are owned by DragonTV Limited and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Your Content:

You retain ownership of all content you create in the App (home configurations, automation rules, etc.). By using the App, you grant us a limited license to store and process your content solely to provide the service.

Our Content:

You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Warranties that the App will be uninterrupted, timely, secure, or error-free
  • Warranties regarding the accuracy or reliability of any information obtained through the App
  • Warranties that defects will be corrected

Important Safety Notice: The App is a convenience tool and should not be relied upon as the sole means of home security or safety monitoring. Always implement proper safety measures and backup systems for critical functions.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DRAGONTV LIMITED SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Damage to property (including damage caused by malfunctioning devices)
  • Personal injury or death resulting from use of the App
  • Unauthorized access to or alteration of your transmissions or data
  • Statements or conduct of any third party on the App
  • Failures of third-party services or integrations

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (OR £100 IF YOU HAVE NOT PAID US ANYTHING).

Some jurisdictions do not allow limitations on implied warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless DragonTV Limited, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use or misuse of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of any applicable laws or regulations
  • Damage caused by devices you control through the App

Service Availability

We reserve the right to:

  • Modify, suspend, or discontinue the App (or any part thereof) at any time with or without notice
  • Impose limits on certain features or restrict access to parts or all of the App
  • Perform maintenance and updates as needed

We will not be liable if for any reason all or any part of the App is unavailable at any time or for any period.

Account Termination

By You:

You may terminate your account at any time by contacting us at support@dragontech.info. Upon termination, your data will be deleted in accordance with our Privacy Policy.

By Us:

We may suspend or terminate your account immediately, without prior notice or liability, for any reason, including if you:

  • Breach these Terms
  • Engage in fraudulent or illegal activity
  • Violate the acceptable use policy
  • Pose a security or legal risk

Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any legal action or proceeding relating to your access to or use of the App shall be instituted in the courts of England and Wales. You agree to submit to the jurisdiction of such courts.

Dispute Resolution

Before filing a legal claim, you agree to try to resolve the dispute informally by contacting us at support@dragontech.info. We will attempt to resolve the dispute through good faith negotiations.

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

  • Updating the "Last Updated" date at the top of these Terms
  • Sending an email notification (if you've provided your email)
  • Displaying a prominent notice in the App

Your continued use of the App after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the App.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced with a valid provision that most closely matches the intent of the original.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DragonTV Limited regarding the App and supersede all prior agreements and understandings.
